Congressmen advocate «permanent solution» for cases of Parole

Three Cuban American congressmen have promised to advocate for Cuban, Haitian, Nicaraguan and Venezuelan immigrants who received the news on the cancellation of the humanitarian parole program with which they arrived in the United States legally.

The humanitarian parole implemented in January 2023 granted a temporary entry permit to the United States, not a permanent residence, more than half a million people backed by a sponsor in the United States. He also granted them the possibility of requesting an employment authorization document (EAD).

After the ruling of the Supreme Court, which allowed President Donald Trump’s government to revoke this mechanism, republican legislators Mario Díaz-Balart, María Elvira Salazar and Carlos Giménez expressed the commitment to manage a route that ensures a legal status to these people, admitted in recent years in the communities they represent.

«We are actively working with the Trump administration to present the case in favor and find a permanent solution for Cuban, Haitian, Nicaraguan and Venezuelan citizens who have fled from political crises and cannot return to their countries of origin due to fears of persecution,» Diaz-Balart wrote.

«We are proud to represent some of the most numerous communities of Cubans, Haitians, Nicaraguans and Venezuelans, and we will not stop advocating them,» said the congressman.

The defense organizations of the migrants have strongly criticized the decision of the Supreme, which impacts equally to immigrants and the families who claimed them with the humanitarian parole. In the case of Venezuelans, they were also affected by the recent cancellation of the temporal protection status (TPS).

The pronouncement of Florida congressmen supports the border security policy promoted by Trump and holds the Biden administration for the crisis on the border.

Carlos Giménez said that «the failed open border policy of the Biden Administration allowed thousands of criminals and gang members to enter our country, leaving us with the disorder to clean. However, many people under protection programs, such as TPS and CHNV, are working members of our communities that deserve our support and protection.»

The Cuban American said: «The decision of the Supreme Court is the law of the country and we must respect it. I am committed to work with the Trump administration to ensure that we protect those who contribute to our communities and follow the law.»

Meanwhile Salazar also urged to respect the verdict of the Supreme but noted that the human cost cannot be ignored.

«There is an undeniable truth: these migrants legally entered the United States, trusting the empty promises of the Biden administration,» he wrote.

«These people flee from brutal regimes and conditions that threaten their lives. Therefore, he urges the administration to use their executive authority and grant the deferred forced output (DED), to prevent them from being sent back to violence and repression,» the legislator proposed.

The ruling of the Supreme Court is based on the discretion of the Secretary of National Security to grant temporary residence permits to foreigners in cases of humanitarian need or significant public benefit, as established in the Immigration and Nationality Law (INA). This discretion allows the federal government, through the USCIS, individually evaluating each case and deciding whether or not to grant the parole.

Friday’s ruling affects Cubans who have not fulfilled the period of one year and a day of residence to be able to benefit from the Cuban Adjustment Law (CAA).

Experts recommend that they explore other legal paths, such as asylum or residence application.
