Prosecutor Patricio Ferrari said before the court: «The witness is being beggar (liar) eloquently.»
According to the Prosecutor’s Office and then the judges were ratified, the witness incurred the crime of false testimony for providing statements that contradict the evidence collected during the investigation.
The main contradiction incurred Coria has to do with his link with the neurosurgeon and head of Maradona, Leopoldo Luque, with whom he denied having a relationship and said he had never spoken, or during household admission or later.
However, numerous tests and chats between the two, exposed at the audience on Tuesday, revealed that the bodyguard held several conversations with the doctor in different periods and even were «friends.»
In one of those Coria messages he wrote to Luque: «How are you, friend. I bank you to die, count on me for whatever you need. «
To which Coria responded to the judges: «I do not remember that he has spoken with him, I sincerely remember.»
Other contradictions in Coria’s statement have to do with who were the people who tried to revive Maradona when he was in the bed where he died, in a house where he received medical care at home.
Maradona’s two daughters’ lawyer, Fernando Burlando, asked for «the extraction of testimonies to give intervention to the Fiscal Unit for Research» and requested the «immediate detention» of the witness for incurring «the crime of false testimony.»
Next, the judges agreed to the request and the one who was Maradona’s bodyguard left the room.
In the session on Tuesday they also declared Andrea Flavia Jordan, real estate agent who managed the rent of the house; Santiago Giorello, owner of the same, and Jana Maradona, one of her daughters, complainant and witness in the cause.
Maradona died at age 60 on November 25, 2020 and, at the time of his death he presented serious liver, cardiac and pulmonary pathologies, according to a forensic report presented by the Prosecutor’s Office.
The neurosurgeon Leopoldo Luque, psychiatrist Agustina Cosachov, psychoanalyst Carlos Díaz, the doctor and coordinator of the company Swiss Medical, Nancy Forlini, the doctor Pedro Di Spagna, the nursing coordinator Mariano Perroni and the nurse Ricardo Almirón are judged in this process.
Nurse Gisela Madrid is also prosecuted, who requested a jury trial and will be judged in a separate case in the second semester of 2025, once the main trial is finished.
Judges Maximiliano Savarino, Verónica Di Tommaso and Julieta Makintach must determine if seven of the eight defendants are guilty of the crime of simple homicide with eventual intent, which has a maximum penalty of 25 years in prison.
